TENDER INVITATION FOR ATTORNEYSHIP SERVICE

Steel Exporters' Association (ÇİB hereafter) is a professional establishment that represents most of the steel exporters of Turkey. ÇİB is assisting its members to increase national exports at the Steel industry and organizing, supervising export activities of members and taking necessary precautions on these activities. ÇİB negotiates with official authorities for solving problems at every level of export process, ensuring the decisions to be taken and realising organisations for that goal.

As you may recall, on September 9, 2024, Canada Border Services Agency (CBSA) has initiated re-investigation and countervailing duty investigations on “Hollow Structural Sections” (7306.30, 7306.50 ve 7306.61 HS codes) originating in Turkey. The letter and notification dated September 10, 2024, from the Canada Border Services Agency (CBSA) indicate that, pursuant to the provisions of the Special Import Measures Act (SIMA) section 76.03(1), the Canadian International Trade Tribunal (CITT) has initiated a final review investigation on September 9, 2024, to extend the measures in light of the decision rendered on October 16, 2019. Consequently, it is stated that the CBSA has launched a re-examination investigation on September 10, 2024, under section SIMA 76.03(7)(a) to assess the likelihood of continued or resumed dumping in the event that the measures expire and the anti-dumping duties are lifted.

Thus, ÇİB is planning to take legal support from a law firm for anti-dumping and countervailing and also on probable cases finalize this investigations process in a positive way in the injury determination stage to defend Turkey.

In conclusion, as ÇİB, we would like to receive “a proposal” about the defence of Turkey in this anti-dumping and countervailing duty investigations and probable cases from your company that should be considered as experienced in anti-dumping and countervailing duty investigations and preferably has a partner in Canada.

The offer should set out a general strategy, information about which cases defended previously and the associated budget. The associated budget should be on “per hour& flat- fee” bases, and total expected budget. Please make sure that your proposal covers injury determination stage fees for ÇİB and hearings if necessary.

In the aforementioned notification, it is stated that the CBSA has requested information from exporters and producers of the products subject to the measures as part of the investigation procedure. The notification specifies that the relevant information is included in the Expiry Review Questionnaire (ERQ) forms and in an Excel file containing production, sales, and trade figures, which are attached to the letter. It is indicated that the submitted information will be utilized in the CBSA's decision-making process regarding the potential continuation or recurrence of dumping in the event that the measures expire. Furthermore, it is emphasized that responses to the aforementioned questionnaire forms must be submitted to the CBSA via email in a complete and accurate manner by October 17, 2024.

Because of our limited time, the deadline for the proposal is 30th September 2024.
